EXECUTIVE ORDER NO. 246 July 24, 1987
PROVIDING FOR THE CREATION OF THE NATIONAL INTELLIGENCE COORDINATING AGENCY AND FOR OTHER PURPOSES
WHEREAS, the President of the Philippines is mandated to complete the reorganization of the government, promote internal stability and preserve sovereignty under the new Constitution;
WHEREAS, there is a need to establish and maintain a mechanism under the Office of the President to integrate national intelligence to insure the stability of government;
NOW, THEREFORE, I, CORAZON, C. AQUINO, President of the Philippines, by virtue of the powers vested in me by the sovereign people and the New Constitution, do hereby order:
Sec. 1. The National Intelligence Coordinating Agency, hereinafter referred to as NICA, is hereby created under the Office of the President to replace the National Intelligence Security Authority (NISA), and the Civil Intelligence and Security Agency (CISA), which are hereby abolished.

Executive Order No. 246
Summary of Executive Order No. 246
Creation of the National Intelligence Coordinating Agency (NICA):
- Establishes the NICA under the Office of the President to replace the National Intelligence Security Authority (NISA) and the Civil Intelligence and Security Agency (CISA), which are abolished. (Sec. 1)
- NICA serves as the focal point for direction, coordination, and integration of government intelligence activities and preparation of intelligence estimates for policy formulation by the President. (Sec. 2)
Leadership and Organizational Structure:
- NICA is headed by a Director-General and a Deputy Director-General, both appointed by the President and serving at the President's pleasure. (Sec. 3)
- The Deputy Director-General assists the Director-General and performs the Director-General's functions in their absence. (Sec. 4)
- NICA is under the administrative supervision of and provides support services to the National Security Council but may report directly to the President as required. (Sec. 5)
- The National Intelligence Board (NIB) continues to serve as an advisory body to the Director-General for intelligence coordination and integration. (Sec. 6)
- NIB members are appointed by the President, and the National Security Director may attend all Board meetings. (Sec. 7)
- NICA's organization consists of: (Sec. 8)
a) Office of the Director-General for overall management and operations.
b) Directorate for Operations, responsible for information collection.
c) Directorate for Production, responsible for intelligence estimates, reports, and automated data processing.
d) Directorate for Administration, responsible for personnel, training, logistics, and support services.
e) Management and Planning Office for formulating plans, policies, and programs.
f) Office of the Comptroller for financial management and control.
g) Field Stations for intelligence collection activities.
- The Director-General recommends NICA's organization and staffing pattern for the President's approval. (Sec. 9)
Transfer of Resources and Personnel:
- Funds, records, equipment, buildings, facilities, and other properties of NISA and CISA, as well as necessary personnel based on qualifications and merit, are transferred to NICA. (Sec. 10)
- Funds necessary to carry out the provisions of this Executive Order shall be included annually in the General Appropriations Act. (Sec. 10)
Retirement Benefits and Separation Pay:
- Personnel whose services are terminated due to the abolition or reorganization of NISA and CISA shall receive retirement benefits under existing laws, rules, and regulations. (Sec. 11)
- Those not entitled to retirement benefits shall receive the equivalent of one-month basic salary for every year of service or the nearest fraction thereof, based on the highest salary received, but not exceeding the equivalent of twelve (12) months' salary. (Sec. 11)
Repealing and Validity Clauses:
- All laws, presidential decrees, executive orders, letters of instructions, and edicts inconsistent with this Executive Order are repealed or modified accordingly. (Sec. 12)
- The invalidity or unconstitutionality of any provision shall not affect other provisions, which shall remain in full force and effect. (Sec. 13)
Effectivity:
- This Executive Order takes effect immediately. (Sec. 14)
