ADMINISTRATIVE ORDER NO. 40

PROVIDING FOR THE ESTABLISHMENT OF INTERIM TRANSPORT TERMINALS IN PREPARATION FOR THE INTEGRATED TRANSPORT SYSTEM UNDER EXECUTIVE ORDER (EO) NO. 67 (s. 2012)

WHEREAS, Executive Order No. 67 (s. 2012) provides for the establishment of integrated transport systems in the North and South of Metro Manila which are projected to be established and fully-operational by 2016 (ITS Project);

WHEREAS, the Department of Transportation and Communication (DOTC), as the designated lead agency in the planning, implementation and monitoring of the ITS Project, proposes that one method of immediately decongesting traffic in Metro Manila is to restrict provincial buses and Asian utility vehicles (AUVs) from entering EDSA;

WHEREAS, in preparation for the full implementation of the ITS project, there is a need to establish interim transport terminals (ITTs) to provide a convenient, efficient, and systematic transport system; to decongest roadways; to promote road and commuter safety; and, to reduce pollution in EDSA; and,

WHEREAS, the LTFRB has issued Memorandum Circular (MC) No. 13-2008...

Summary of Administrative Order No. 40

Establishment of Interim Transport Terminals (ITTs)
- ITTs shall be established for loading/unloading of provincial buses and Asian utility vehicles (AUVs) entering Metro Manila, and their transfer to city buses/AUVs within Metro Manila. (Section 1)
- DOTC and LTFRB shall define and identify the affected provincial buses and AUVs. (Section 1)

ITT Locations
- North Interim Transport Terminal: For buses/AUVs from northern provinces entering via NLEX, MacArthur Highway, Mindanao Avenue, Quirino Avenue, and Commonwealth Avenue. (Section 2a)
- South Interim Transport Terminal: For buses/AUVs from southern provinces entering via SLEX. (Section 2b)
- Southwest Interim Transport Terminal: For buses/AUVs from southern provinces entering via Coastal Road and Manila Cavite Expressway. (Section 2c)

Implementing Agencies
- DOTC shall be responsible for developing the North ITT. (Section 3a)
- DPWH and DOTC shall be responsible for developing the South ITT. (Section 3b)
- MMDA and DOTC shall be responsible for developing the Southwest ITT. (Section 3c)
- DOTC shall be the lead coordinating agency. (Section 3)

Maintenance of ITTs
- ITTs shall be maintained per LTFRB Memorandum Circular No. 13-2008 standards. (Section 4)
- DOTC, with MMDA assistance, shall maintain ITTs, but arrangements with bus/AUV operators/owners are allowed. (Section 4)
- Appropriate fees for ITT maintenance may be collected by DOTC, MMDA, bus operators/owners, or designated private entity. (Section 4)

Route Amendments
- LTFRB shall amend routes of affected provincial buses/AUVs to end at ITTs. (Section 5)
- LTFRB shall adjust routes of city buses, AUVs, and jitneys to enable transport to/from ITTs. (Section 5)

Operation Period
- ITTs shall cease operations within 60 days after DOTC determines permanent ITS Terminals are fully operational. (Section 6)

Funding
- Funds shall be sourced from ITS Project appropriations and funds identified by DBM. (Section 7)

Other Provisions
- Separability clause for invalid/unconstitutional parts. (Section 8)
- Repeals previous inconsistent issuances. (Section 9)
- Effective immediately upon publication in a newspaper of general circulation. (Section 10)
