Providing for the Reorganization of the Local Development Council

Executive Order No. 319

EXECUTIVE ORDER NO. 319 March 4, 1988
(repealed by R.A. 7160)

PROVIDING FOR THE REORGANIZATION OF THE LOCAL DEVELOPMENT COUNCIL

WHEREAS, there is a need to strengthen the mechanism for coordinating the efforts of national and local government officials and non-governmental organizations to accelerate economic and social growth and development at the regional and local levels;

WHEREAS, there is a need for greater participation from the private sector and non-governmental organizations in the development planning process;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order the following:

Sec. 1. Reorganization and Strengthening of the Local Development Councils. The Provincial Development Councils, City Development Councils, Municipal Development Councils and Barangay Development Councils are hereby reorganized and strengthened. The Councils shall assist local legislative bodies in setting the direction of economic and social development and coordinating development efforts in their respective territorial jurisdictions.

1.1 Composition of the Local Development Councils.

EXECUTIVE ORDER NO. 319: REORGANIZATION OF LOCAL DEVELOPMENT COUNCILS

I. Purpose (Preamble):
- Strengthen coordination between national and local governments, and non-governmental organizations for economic and social growth.
- Increase private sector and NGO participation in development planning.

II. Reorganization of Local Development Councils (Sec. 1):
- Provincial, City, Municipal, and Barangay Development Councils are reorganized and strengthened.
- Assist local legislative bodies in setting development direction and coordinating efforts.

III. Composition of Local Development Councils (Sec. 1.1):

1. Barangay Development Council:
- Headed by Barangay Captain.
- Members include:
    i. Sangguniang Barangay (Sec. 1.1.1)
    ii. Department of Local Governments officer assigned to municipality (Sec. 1.1.1)
    iii. Representatives of government agencies working in barangay (Sec. 1.1.1)
    iv. Representatives of private sector and NGOs operating in barangay (Sec. 1.1.1)

2. City and Municipal Development Councils:
- Headed by Mayor.
- Members include:
    i. Barangay Captains (Sec. 1.1.2)
    ii. Chairman of Appropriations Committee of Sangguniang Panglungsod/Bayan (Sec. 1.1.2)
    iii. Heads of offices of departments and agencies represented in the Cabinet (one per agency) (Sec. 1.1.2)
    iv. Representatives of private sector and NGOs (not more than 1/4 of members) (Sec. 1.1.2)

IV. Executive Committee (Sec. 2):
- Local Development Councils may create an Executive Committee by resolution.
- Define membership, functions, and responsibilities.

V. Sectoral or Functional Committees (Sec. 3):
- Local Development Councils may organize sectoral or functional committees.

VI. Secretariat (Sec. 4):
- Provide technical support and documentation.
- Barangay Development Council Secretariat headed by Barangay Secretary and assisted by Department of Local Governments officer (Sec. 4.1).
- Municipal, City, and Provincial Development Council Secretariats headed by respective Planning and Development Coordinators (Sec. 4.2).
- Councils determine secretariat membership (Sec. 4.3).
- Government agencies to provide technical support upon request (Sec. 4.4).
- Councils may avail services of NGOs, educational, and research institutions (Sec. 4.4).

VII. Functions of Local Development Councils (Sec. 5):

1. Provincial, City, and Municipal Development Councils:
    i. Formulate long-term, medium-term, and annual socio-economic development plans and policies (Sec. 5)
    ii. Formulate medium-term and annual public investment programs (Sec. 5)
    iii. Appraise and prioritize socio-economic development programs and projects (Sec. 5)
    iv. Formulate local investment incentives to promote private investment (Sec. 5)
    v. Coordinate, monitor, and evaluate programs and projects (Sec. 5)
    vi. Perform other functions provided by law or competent authority (Sec. 5)

2. Barangay Development Council:
    i. Mobilize citizen participation in local development efforts (Sec. 5)
    ii. Identify programs and projects based on local requirements (Sec. 5)
    iii. Monitor and evaluate program and project implementation (Sec. 5)
    iv. Perform other functions provided by law or competent authority (Sec. 5)

VIII. Relation to Local Legislative Bodies and Regional Development Council (Sec. 6):

1. Sangguniang Barangay approves policies, programs, and projects proposed by Barangay Development Council before submission to City or Municipal Development Council (Sec. 6.1).

2. Sangguniang Panglungsod and Sangguniang Bayan approve policies, programs, and projects proposed by City or Municipal Development Councils before submission to Provincial Development Council (Sec. 6.2).

3. Sangguniang Panlalawigan approves policies, programs, and projects proposed by Provincial Development Council before submission to Regional Development Council (Sec. 6.3).

4. Regional Development Council integrates approved policies, programs, and projects into Regional Development Plan before submission to NEDA Board (Sec. 6.4).

IX. Budget Information (Sec. 7):
- Department of Budget and Management to furnish Councils with information on financial resources applicable to their jurisdictions.

X. Planning and Budgeting Measures (Sec. 8):
- NEDA Board Development Budget Coordination Committee, in coordination with Department of Local Governments, to modify budget preparation process.
- Issue guidelines for greater autonomy to Councils in programs and projects consistent with development plans and national priorities.

XI. Implementing Authority (Sec. 9):
- NEDA Board, in coordination with Department of Local Governments, Provincial Governors and City Mayors League, and Municipal Mayors League, authorized to promulgate rules and regulations.

XII. Repealing Clause (Sec. 10):
- All orders, rules, regulations, and issuances inconsistent with this Order are repealed or modified accordingly.

XIII. Effectivity (Sec. 11):
- This Executive Order takes effect immediately.
