Executive Order No. 232

EXECUTIVE ORDER NO. 232 July 22, 1987

PROVIDING FOR THE STRUCTURAL AND FUNCTIONAL REORGANIZATION OF THE NATIONAL COUNCIL FOR THE WELFARE OF THE DISABLED PERSONS AND FOR OTHER PURPOSES

WHEREAS, the national government recognizes its responsibility to provide disabled persons with the fullest measure of protection and assistance to help develop their abilities in all fields of endeavor and to promote their integration into the mainstream of society, as well as its primary duty for the prevention of disabilities;

WHEREAS, the national government is also cognizant of the limitations of the existing system for delivery of services to persons with disabilities and the need to extend the ranges of disability prevention and rehabilitation services;

WHEREAS, there is an increasing awareness in the government and private sectors on the problems of disability of their joint responsibility to be involved in the national effort to seek solutions to the problems;

Providing for the Structural and Functional Reorganization of the National Council for the Welfare of Disabled Persons

- Declaration of Policy (Sec. 2)
• The State affirms its paramount concern for the welfare of disabled persons as embodied in the 1987 Constitution.

- Objectives of the Council (Sec. 3)
• To develop a comprehensive national plan for disability prevention, rehabilitation, full participation, and equalization of opportunities for disabled persons. (Sec. 3.1)
• To ensure essential programs and services for disabled persons are adequate and accessible. (Sec. 3.2)
• To maintain steps to ensure the rights and benefits of disabled persons for fuller participation and equalization of opportunities. (Sec. 3.3)
• To advocate new policies and legislations related to disability prevention, rehabilitation, full participation, and equalization of opportunities. (Sec. 3.4)
• To act as a consultative forum, advisory and coordinating body for agencies involved in disability-related matters. (Sec. 3.5)
• To establish and maintain contact with national and international organizations concerned with disabilities. (Sec. 3.6)
• To raise public awareness on disability prevention, rehabilitation, full participation, and equalization of opportunities through systematic information programs. (Sec. 3.7)
• To develop and maintain a data banking and referral system on disability-related matters. (Sec. 3.8)

- Powers and Functions of the Council (Sec. 4)
• Formulate policies on disability prevention and rehabilitation for the welfare of disabled persons. (Sec. 4.1)
• Formulate research and development policies on health, education, labor, and social welfare for disabled persons. (Sec. 4.2)
• Undertake continuing research and related studies on disability prevention, rehabilitation, and equalization of opportunities. (Sec. 4.3)
• Formulate integrated and comprehensive long and medium-term national plans on the welfare of disabled persons. (Sec. 4.4)
• Establish and maintain linkages and networking with local and international organizations, including organizations of and for disabled persons. (Sec. 4.5)
• Conduct program evaluation, monitoring, consultative meetings, and symposia on disability-related issues. (Sec. 4.6)
• Propose legislation and initiate advocacy programs for the welfare of disabled persons. (Sec. 4.7)
• Develop a broad public information and dissemination program on disability prevention, rehabilitation, full participation, and equalization of opportunities. (Sec. 4.8)
• Submit periodic reports to the DSWD Secretary on the Council's activities. (Sec. 4.9)
• Establish and maintain a data bank and referral system on disability prevention, rehabilitation, full participation, and equalization of opportunities. (Sec. 4.10)

- Composition of the Council (Sec. 5)
• The Council is headed by a governing Board composed of heads or representatives of governmental and non-governmental organizations, disabled persons, and civic and cause-oriented organizations.
• The Board includes representatives from various government departments and agencies, as well as non-government organizations and private representatives.
• The private representatives include two disabled persons and one each from a civic group and a cause-oriented organization, appointed by the President for a three-year term.

- Duties of the Chairman (Sec. 6)
• To call and preside over Board meetings.
• To manage and administer the Council's affairs.
• To ensure implementation of the Board's decisions and policies.
• To sign for and represent the Council.
• To accept gifts, grants, or donations on behalf of the Council and administer and disburse them with the Board's approval.
• To enter into and execute contracts necessary for the Council's objectives, subject to the Board's approval.
• To organize permanent or ad-hoc committees consisting of Board members or experts.

- Meetings (Sec. 7)
• The Board shall meet every month or as called by the Chairman.
• Eleven members shall constitute a quorum, and decisions made by the quorum must carry the unanimous vote of all eleven members to be valid.
• Board members shall receive honorarium and other allowances as resolved by the Board and authorized by the Department of Budget and Management.

- The Secretariat (Sec. 8)
• The Council shall have a Secretariat to coordinate functions, organize services, and evaluate programs as required by the Board.
• The Secretariat shall be headed by an Executive Director and a Deputy Executive Director, both appointed by the President.
• The main divisions of the Secretariat are: Office of the Executive Director, Administrative Division, Programs Management Division, Information, Education and Communication Division, and Technical Cooperation Center.

- The Executive Committee (Sec. 9)
• An Executive Committee shall be created to assist the Board.
• The Executive Committee shall be chaired by the DSWD Undersecretary for attached agencies and composed of nine members chosen by the Chairman.

- Other Committees (Sec. 10)
• The Board shall create committees as deemed necessary to carry out the Council's functions.

- Appropriations (Sec. 11)
• Funds needed to carry out the provisions of this Executive Order shall be taken from the funds available to the former National Commission Concerning Disabled Persons (NCDP).
• Thereafter, the budget needed for the Council's continued operation shall be regularly included in subsequent annual general appropriations acts.

- Donations (Sec. 12)
• The Council is authorized to receive grants, donations, contributions, or gifts, which shall be administered or disbursed for the purpose for which they were given or as determined by the Board, in accordance with government rules and regulations.

- Repealing Clause (Sec. 13)
• All laws, ordinances, rules, regulations, other issuances or parts thereof which are inconsistent with this Executive Order are hereby repealed or modified accordingly.

- Effectivity (Sec. 14)
• This Executive Order shall take effect immediately.
