Providing Measures for the Protection of the Desiccated Coconut Industry

Executive Order No. 826

EXECUTIVE ORDER NO. 826 August 28, 1982

PROVIDING MEASURES FOR THE PROTECTION OF THE DESICCATED COCONUT INDUSTRY

WHEREAS, it is the declared policy of the state to promote the rapid integrated development and growth of the coconut and other palm oil industry in all its aspects;

WHEREAS, there are certain enterprises in the industry, mainly the coconut desiccators, which are major end-users of fresh/matured coconuts converted into processed commodities that contribute a significant share in the export of coconut products;

WHEREAS, the export performance of these coconut-based commodities has tremendously declined due mainly to the unabated increase in production capacity resulting in cutthroat competition, over-production, underselling and smuggling of poor quality products thereby threatening the very existence of this labor-intensive industry and resulting in a dramatic decline of export receipts from this sector of the coconut industry;

WHEREAS, it is to the national interest that the government rationalize the desiccated coconut industry in order to insure its survival, growth and viability;

Summary of Executive Order No. 826

Prohibition on Establishing New Desiccated Coconut Processing Plants (Section 1):
- No government agency shall authorize or grant permits for establishing new desiccated coconut processing plants.
- Exception: The Philippine Coconut Authority (PCA) may authorize new plants or expansion, relocation, or upgrading of existing plants after evaluating:
    - Existing market demand (Section 1a)
    - Prevailing production capacity in the country or locality (Section 1b)
    - Level and flow of raw materials (Section 1c)
    - Other circumstances affecting the industry's growth or viability (Section 1d)
- Such authorization is subject to the President's approval.

Regulatory Powers of the Philippine Coconut Authority (Section 2):
- PCA has full power and authority to:
    - Regulate marketing and exportation of desiccated coconut.
    - Determine and impose limitations on production capacities of firms engaged in desiccated coconut production.
    - Issue orders, rules, and regulations, including:
        - Imposing floor and/or ceiling prices for exports.
        - Prescribing quality standards.
        - Establishing maximum export quantities for particular periods and markets.
        - Inspecting and surveying export shipments.

Additional Measures (Section 3):
- PCA, in consultation with coconut desiccators' associations, shall study and recommend additional feasible measures to ensure the growth and viability of the desiccated coconut and allied industries using fresh/matured coconuts as raw material.
- Recommendations are subject to the President's approval.

Effectivity (Section 4):
- This Executive Order takes effect immediately.
