Executive Order No. 302

Purpose and Objectives (Section 1):
- Adopt rules and regulations for procurement of goods/supplies for project-related and regular operations/maintenance activities of the National Government.
- Purchase goods of acceptable quality at fair prices from qualified suppliers with on-time delivery.
- Ensure fair treatment of suppliers, including prompt payments.
- Accomplish procurement through open competitive bidding for economy and efficiency.
- Maintain and collect data to refine procurement policies and procedures.

Approving Authority (Section 2):
- Levels of approving authority shall be prescribed under Executive Order Nos. 301 and 380.

Procurement Method (Section 3):
- Contracts shall be awarded through public/open competitive bidding, unless another method is necessary as prescribed in the implementing rules and regulations.

Prequalification, Bid and Award Committee (Section 4):
- Each agency shall have a committee responsible for conducting bidding, evaluating results, and recommending contract award.
- Committee composition:
  - Chairman: At least third-ranking official
  - Executive Officer and Secretary: Legal Officer of the Agency
  - Members: One regular technical member and at least two provisional members with project knowledge
  - Observer: One representative from the Commission on Audit
  - Private Sector Representatives: One representative each from the Philippine Chamber of Commerce and Industry, and an end-user group or non-government organization (observers only)

Committee Functions (Section 5):
- Conduct bidding.
- Evaluate bidding results.
- Recommend award of contract.

Implementation (Section 6):
- The Committee on Infrastructure (INFRACOM) of the NEDA Board shall formulate and promulgate the implementing rules and regulations, subject to the President's approval.

Repealing Clause (Section 7):
- All inconsistent Presidential directives, issuances, orders, rules, and regulations are repealed or modified accordingly.

Separability Clause (Section 8):
- If any provision is held invalid, the other provisions shall remain valid and continue in operation.

Effectivity (Section 9):
- This Executive Order shall take effect immediately.

EXECUTIVE ORDER NO. 302 February 19, 1996 PROVIDING POLICIES, GUIDELINES, RULES AND REGULATIONS FOR THE PROCUREMENT OF GOODS/SUPPLIES BY THE NATIONAL GOVERNMENT WHEREAS, the present policies, guidelines, rules and regulations covering contracts for the procurement of goods/supplies for project-related and normal/regular operations and maintenance activities of the National Government appear to be, generally, fragmented; WHEREAS, in the interest of public service, the procurement of goods/supplies by the National Government must be based on the public economy; WHEREAS, as a consequence of the continuous increase in development projects, operations and maintenance requirements of the National Government, contracts for the procurement of goods/supplies have substantially increased; NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby order: SECTION 1. A set of rules and regulations covering contracts for the procurement of goods and supplies for both project-related and normal/regular operation and maintenance activities of the National Government be adopted for the following purposes: a. to purchase goods of acceptable quality at fair and reasonable prices...
