Proclamation No. 472

PUBLISHING PROCLAMATIONS, EXECUTIVE ORDERS, AND REGULATIONS RELATING TO NEUTRALITY, ISSUED BY THE PRESIDENT AND THE SECRETARY OF STATE OF THE UNITED STATES, FROM SEPTEMBER 5 TO SEPTEMBER 11, 1939.

Whereas the President of the United States did on September 5, 8, and 10, 1939, issue the following proclamations:

1. EXPORT OF ARMS, AMMUNITION, AND IMPLEMENTS OF WAR TO FRANCE; GERMANY; POLAND; THE UNITED KINGDOM, INDIA, AUSTRALIA, AND NEW ZEALAND.

"Whereas section 1 of the joint resolution of Congress approved May 1, 1937, provides in part as follows:

" Whenever the President shall find that there exists a state of war between, or among, two or more foreign states, the President shall proclaim such fact and it shall thereafter be unlawful to export or attempt to export, or cause to be exported, aims, ammunition, or implements of war from any place in the United States to any belligerent state named such proclamation, or to any neutral state for transshipment to, or for...

Summary of Proclamations, Executive Orders, and Regulations Relating to Neutrality

Proclamations by the President of the United States:

1. Export of Arms, Ammunition, and Implements of War (Sections 1, 11):
- Prohibits export of enumerated arms, ammunition, and implements of war from the U.S. to France, Germany, Poland, United Kingdom, India, Australia, New Zealand, and later extended to Union of South Africa and Canada.
- Enumerates specific categories of prohibited items.
- Violators subject to fine up to $10,000 or imprisonment up to 5 years, and forfeiture of property.
- Authorizes the Secretary of State to promulgate regulations.

2. National Emergency (Section 11):
- Proclaims a national emergency to observe neutrality and strengthen national defense.

3. Neutrality of the U.S. (Sections 1, 11):
- Declares neutrality of the U.S. in the war between Germany and France, Poland, United Kingdom, India, Australia, New Zealand, and later extended to Union of South Africa and Canada.

Executive Orders by the President:

4. Enforcement of Neutrality (Section 11):
- Prescribes regulations governing enforcement of neutrality, applying to Union of South Africa and Canada.

Regulations by the President:

5. Credits to Belligerents (Section 3):
- Excepts ordinary commercial credits and short-term obligations from prohibition on extending credits to belligerents.
- Applies to France, Germany, Poland, United Kingdom, India, Australia, New Zealand, and later extended to Union of South Africa and Canada.

Regulations by the Secretary of State:

6. Solicitation and Collection of Contributions (Sections 3, 11):
- Requires registration and reporting for soliciting or collecting contributions for medical aid, food, or clothing in belligerent countries, not acting on behalf of governments.
- Applies to France, Germany, Poland, United Kingdom, India, Australia, New Zealand, and later extended to Union of South Africa and Canada.
- Excludes American National Red Cross.

7. Travel on Belligerent Vessels (Sections 9, 11, 12):
- Prohibits U.S. citizens from traveling on vessels of belligerent countries, except for specific exemptions.
- Applies to France, Germany, Poland, United Kingdom, India, Australia, New Zealand, and later extended to Union of South Africa and Canada.
- Violators subject to fine up to $10,000 or imprisonment up to 5 years.

8. Export Regulations (Sections 1, 6, 10, 11):
- Prohibits export of enumerated arms, ammunition, and implements of war to belligerent countries.
- Requires evidence that exports are not destined for belligerent countries.
- Prohibits American vessels from carrying arms to belligerent countries, with exceptions for small arms necessary for discipline.
- Applies to France, Germany, Poland, United Kingdom, India, Australia, New Zealand, and later extended to Union of South Africa and Canada.
