RECONSTITUTING THE NATIONAL ACTION COMMITTEE ON ANTI-HIJACKING AS THE NATIONAL ACTION COMMITTEE ON ANTI-HIJACKING AND ANTI-TERRORISM
WHEREAS, terrorism has indiscriminately caused great havoc and destruction to lives and properties in this country in recent months:
WHEREAS, the threat of terrorism is undermining the positive image our country has promoted abroad thereby causing ill effects to our growing economy:
WHEREAS, there is a need to establish linkage with international anti-terrorist agencies for as to actively participate in the global crusade against terrorism;
WHEREAS, the existing anti-hijacking measures need to be complemented with a more expanded law to enable our authorities to effectively counter not only hijacking but all other forms of terrorism.
WHEREAS, it is imperative that further appropriate and forceful measures be undertaken to develop the capability of our law enforcement agencies to fight terrorism by reconstituting the National Action Committee on Anti-Hijacking (NACAH).

Executive Order No. 246
Summary of Executive Order No. 246
Reconstitution of National Action Committee on Anti-Hijacking (NACAH)
• The National Action Committee on Anti-Hijacking (NACAH) is reconstituted and renamed as the National Action Committee on Anti-Hijacking and Anti-Terrorism (NACAHT). (Section 1)
Composition of NACAHT
• The committee comprises the following members:
- Secretary of the Interior and Local Government (Chairman)
- Secretary of National Defense (Vice Chairman)
- Secretary of Foreign Affairs
- Secretary of Finance
- Secretary of Justice
- Secretary of Transportation and Communications
- Press Secretary
- National Security Adviser
- Director General, National Intelligence Coordinating Agency
- Presidential Consultant on Police Affairs
- Group Commander, Presidential Security Group (Section 2)
Functions of NACAHT
• Formulate plans to direct, control, supervise and integrate all measures aimed at preventing and suppressing hijacking, other threats to civil aviation, and all other forms of terrorism. (Section 3)
• Adopt measures to:
- Effectively monitor the activities of suspected terrorists. (Section 3)
- Develop the capability of local law enforcement agencies to contain the threats of terrorism. (Section 3)
• Establish close coordination and cooperation with concerned agencies of countries opposing international terrorism to actively participate in the global fight against terrorism. (Section 4)
• Enhance the intelligence and operational functions of concerned entities and authorities in dealing with crimes perpetrated by terrorists. (Section 4)
Authority of NACAHT
• NACAHT is authorized to call upon other government departments, bureaus, offices, agencies and instrumentalities to provide assistance in the effective implementation of this Executive Order. (Section 5)
Absorption of NACAH's Powers, Functions, and Resources
• All powers, functions, and resources of NACAH, as stipulated in Letter of Instruction No. 399 dated 28 April 1976, as amended by Executive Order Nos. 393 and 452, shall be absorbed by NACAHT. (Section 6)
Modification of Previous Orders
• Letter of Instruction No. 399, series 1976, and Executive Orders No. 393, series 1990 and No. 452, series 1991 are accordingly modified. (Section 7)
Effectivity
• The Executive Order shall take effect immediately. (Section 8)
