Executive Order No. 116

EXECUTIVE ORDER NO. 116 January 30, 1987

RENAMING THE MINISTRY OF AGRICULTURE AND FOOD AS MINISTRY OF AGRICULTURE, REORGANIZING ITS UNITS; INTEGRATING ALL OFFICES AND AGENCIES WHOSE FUNCTIONS RELATE TO AGRICULTURE AND FISHERY INTO THE MINISTRY AND FOR OTHER PURPOSES.

RECALLING that the reorganization of the government is mandated expressly in Article II, Section 1 (a) and Article III of the Freedom of Constitution;

HAVING IN MIND that, pursuant to Executive Order No. 5 (1986), it is directed that necessary and proper changes in the organizational and functional structures of the government, its agencies and instrumentalities, be effected in order to promote economy, efficiency, and effectiveness in the delivery of public services;

CONSIDERING that the new government has given the highest priority to agricultural development in order to achieve equitable distribution of benefits and opportunities and to enable farmers and rural populations to maximize their contribution to the economy;

Reorganization Act of the Ministry of Agriculture and Food

Renaming and Reorganization
- Renames the Ministry of Agriculture and Food as the Ministry of Agriculture. (Sec. 2)
- Reorganizes the Ministry structurally and functionally. (Sec. 2)

Declaration of Policy
- Promote the well-being of farmers, share tenants, leaseholders, settlers, fishermen, and other rural workers by providing an environment to increase their income, improve living conditions, and maximize contributions to the national economy. (Sec. 3)
- Accelerate agricultural development and enhance production of agricultural crops, fisheries, and livestock by optimizing resource use and applying advanced farming systems/modern technology to attain food security for domestic use and expand/diversify agricultural production for export. (Sec. 3)
- Encourage private initiative in agri-business ventures for production and exportation/importation of food and allied commodities. (Sec. 3)

Mandate
- The Ministry is responsible for promoting agricultural development by providing the policy framework, public investments, and support services needed for domestic and export-oriented business enterprises. (Sec. 4)
- Improve farm income and generate work opportunities for farmers/fishermen and other rural workers. (Sec. 4)
- Encourage people's participation in agricultural policy-making bodies. (Sec. 4)
- Use a bottom-up self-reliant farm systems approach emphasizing social justice, equity, productivity, and sustainability in the use of agricultural resources. (Sec. 4)

Powers and Functions
- Provide integrated services to farmers/fishermen and other food producers on production, utilization, conservation, and disposition of agricultural and fishery resources. (Sec. 5a)
- Responsible for planning, policy formulation, regulation, execution, monitoring, and programs/activities relating to agriculture/food production and supply. (Sec. 5b)
- Promulgate and enforce laws, rules, and regulations governing the conservation and proper utilization of agricultural resources. (Sec. 5c)
- Establish central and regional information systems for production, marketing, and financing data requirements of farmers and domestic/foreign investors in agri-business ventures. (Sec. 5d)
- Provide comprehensive and effective extension services and training to farmers and other agricultural entrepreneurs on production, marketing, and financing aspects of agricultural enterprises. (Sec. 5e)
- Conduct, coordinate, and disseminate research studies on appropriate technologies for the improvement/development of agricultural crops, fisheries, and other allied commodities. (Sec. 5f)
- Provide the mechanism for the participation of farmers/fishermen and entrepreneurs at all levels of policy making and plan/program formulation. (Sec. 5g)
- Coordinate with and/or call upon other public and private agencies for cooperation and assistance on matters affecting Ministry plans, policies, and programs. (Sec. 5h)

Structural Organization
- The Ministry shall consist of the Ministry Proper, Services, Bureaus, and Regional, Provincial, Municipal, and Barangay Offices. (Sec. 6)

Minister of Agriculture
- The authority and responsibility for exercising the mandate and discharging the powers and functions of the Ministry shall be vested in the Minister of Agriculture, appointed by the President. (Sec. 7)
- Functions of the Minister include: advising the President on rules and regulations, establishing policies and standards, promulgating rules and regulations, exercising supervision and control over the Ministry, delegating authority, and performing other functions assigned by the President. (Sec. 7a-f)

Assistance to Minister
- The Minister shall be assisted by five (5) Deputy Ministers, five (5) Assistant Ministers, the head of the National Food Authority, and the Philippine Coconut Authority with the rank of Deputy Minister, and such number of Deputy and Assistant Ministers appointed by the President upon the recommendation of the Minister. (Sec. 9)

Deputy Ministers
- The five (5) Deputy Ministers shall be assigned to oversee Regional Operations, Staff Operations, Policy and Planning, Attached Agencies, and Special Concerns. (Sec. 10a-e)
- Functions of Deputy Ministers include: advising the Minister, exercising supervision and control, promulgating rules and regulations, coordinating functions and activities, exercising delegated authority, and performing other functions assigned by the Minister. (Sec. 11a-f)

Assistant Ministers
- Each of the five (5) Assistant Ministers shall head one of the Groups: Production, Agri-Business, Research, Training and Extension, Planning and Monitoring, and Support. (Sec. 12a-e)
- Functions of Assistant Ministers include overseeing their respective Groups and performing other functions assigned by the Minister. (Sec. 12)

Production Group
- Consists of the Bureaus of Animal Industry, Plant Industry, Fisheries and Aquatic Resources, and Soils and Water Management. (Sec. 13a-d)
- Each Bureau is responsible for formulating plans, programs, policies, rules, and regulations, and providing technical assistance in their respective sectors. (Sec. 13a-d)

Research, Training and Extension Group
- Consists of the Bureau of Agricultural Research, Agricultural Training Institute, and Bureau of Agricultural Cooperatives Development. (Sec. 14a-c)
- Responsible for coordinating and conducting agricultural research, training agricultural extension workers and their clientele, and promoting the development and evaluation of agricultural cooperatives. (Sec. 14a-c)

Agri-Business Group
- Consists of the Marketing Assistance Services and Agri-Business Investment Information Services. (Sec. 15a-b)
- Responsible for identifying markets for Philippine agricultural products, assisting in planning market centers and distribution networks, gathering and collating data related to agri-business, and providing information on agri-business investment opportunities. (Sec. 15a-b)

Planning and Monitoring Group
- Consists of the Planning and Monitoring Services, Computer Services, and Bureau of Agricultural Statistics. (Sec. 16a-c)
- Responsible for formulating and integrating plans and programs, monitoring implementation, developing and maintaining electronic data processing requirements, and collecting, compiling, and releasing agricultural statistics. (Sec. 16a-c)

Support Group
- Consists of the Financial and Management Service and Administrative Service. (Sec. 17a-b)
- Responsible for providing services related to budgeting, accounting, management, personnel, legal, records, and other general services. (Sec. 17a-b)

Regional Offices
- The Ministry is authorized to establish, operate, and maintain a Regional Office in each administrative region, headed by a Regional Director and three (3) Assistant Regional Directors. (Sec. 18)
- Responsibilities of Regional Offices include providing frontline services, implementing laws, policies, plans, programs, projects, rules, and regulations of the Ministry, coordinating with other regional offices and local government units, and performing other functions assigned by the Minister. (Sec. 18a-e)

Attached Units
- Councils/Committees attached to the Ministry: Agricultural Credit Policy Council, National Agricultural and Fishery Council, Philippine Technical and Administrative Committee for SEAFDEC, National Nutrition Council, and Livestock Development Council. (Sec. 19a)
- Corporations/Agencies attached to the Ministry: Fertilizer and Pesticide Authority, Fiber Industry Development Authority, National Tobacco Administration, Sugar Regulatory Administration, National Food Authority and its subsidiaries, Quedan Guarantee Fund Board, Philippine Fisheries Development Authority, Philippine Rice Research Institute, and Philippine Coconut Authority and its subsidiaries. (Sec. 19b)

Mergers
- Various tobacco-related offices and agencies are merged into the National Tobacco Administration. (Sec. 20a)
- The Philippine Agricultural Training Council, Philippine Training Center for Rural Development, and Bureau of Agricultural Extension are merged into the Agricultural Training Institute. (Sec. 20b)

Abolition
- The National Meat and Inspection Commission is abolished, and its functions are transferred to a division of the Bureau of Animal Industry. (Sec. 21a)
- The National Artificial Rain Stimulation Committee is abolished, and its functions are transferred to a division of the Bureau of Soils and Water Management. (Sec. 21b)
- The Farm Systems Development Corporation's functions are transferred to the respective regional offices of the Ministry. (Sec. 21c)
- The Green Revolution Expanded Program Action Committee is abolished. (Sec. 21d)

Transitory Provisions
- Outlines the procedures for transferring functions, appropriations, funds, records, equipment, facilities, assets, liabilities, and personnel from abolished, merged, or reorganized units to the Ministry. (Sec. 22a-f)
- Personnel whose positions are not included in the Ministry's new position structure and staffing pattern or who are not reappointed shall be deemed separated from the service and entitled to certain benefits. (Sec. 22a-f)

New Structure and Pattern
- The new position structure and staffing pattern of the Ministry shall be approved and prescribed by the Minister within 120 days from the approval of this Executive Order. (Sec. 23)
- Incumbents whose positions are not included or who are not reappointed shall be deemed separated from the service and entitled to certain benefits. (Sec. 23)

Periodic Performance Evaluation
- The Minister is required to formulate and enforce a system of measuring and evaluating the performance of the Ministry periodically and objectively, and submit the same annually to the President. (Sec. 24)

Notice or Consent Requirement
- If any reorganizational change requires notice to or consent of creditors pursuant to any agreement, such notice or consent shall be complied with prior to the implementation of such change. (Sec. 25)

Change of Nomenclature
- In the event of the adoption of a new Constitution providing for a presidential form of government, the Ministry shall be called the Department of Agriculture, and the titles of Minister, Deputy Minister, and Assistant Minister shall be changed to Secretary, Undersecretary, and Assistant Secretary, respectively. (Sec. 26)

Prohibition against Change
- No change in the reorganization prescribed shall be valid except upon prior approval of the President for the purpose of promoting efficiency and effectiveness in the delivery of public services. (Sec. 27)

Funding
- Funds needed to carry out the provisions of this Executive Order shall be taken from funds available in the Ministry. (Sec. 28)

Implementing Authority of Minister
- The Minister shall issue rules, regulations, and other issuances as necessary to ensure the effective implementation of the provisions of this Executive Order. (Sec. 29)

Separability
- Any portion or provision of this Executive Order that may be declared unconstitutional shall not have the effect of nullifying other portions or provisions as long as such remaining portions or provisions can still subsist and be given effect in their entirety. (Sec. 30)

Repealing Clause
- All laws, ordinances, rules, regulations, other issuances or parts thereof, which are inconsistent with this Executive Order, are hereby repealed or modified accordingly. (Sec. 31)

Effectivity
- This Executive Order shall take effect immediately upon its approval. (Sec. 32)
