RENAMING THE MINISTRY OF AGRICULTURE AS THE MINISTRY OF AGRICULTURE AND FOOD, TRANSFERRING TO IT CERTAIN AGENCIES ENGAGED IN FOOD PRODUCTION AND FOR OTHER PURPOSES
WHEREAS, under the New Republic, national development shall be pursued with renewed dedication and greater determination through more efficient, effective and economical government;
WHEREAS, agricultural production, particularly that subsector concerned with the supply of food, has become even more critical for both domestic food requirements and the export of agricultural commodities, in the light of recent economic developments;
WHEREAS, the policies and programs concerned with food production and agricultural crops must be more closely coordinated in order to promote effective performance among the implementing agencies involved;
WHEREAS, certain of these agencies should be placed directly under an integrated ministry in order that primary authority and responsibility for the major food production programs may be properly identified; and

Executive Orders
Renaming the Ministry of Agriculture as the Ministry of Agriculture and Food, Transferring to It Certain Agencies Engaged in Food Production and for Other Purposes
Executive Order No. 967
Summary of Executive Order No. 967
Policy and Goals (Section 1):
- Promote production of agricultural crops, livestock, poultry, and fisheries through efficient resource utilization, private enterprise, and agri-business ventures.
- Achieve self-sufficiency in domestic food requirements and expand/diversify agricultural exports.
- Improve real incomes of farmers and agricultural workers through increased productivity, efficient pricing, marketing, land management, and incentives.
Renaming and Responsibilities (Section 2):
- The Ministry of Agriculture is renamed the Ministry of Agriculture and Food.
- The Minister of Agriculture is renamed the Minister of Agriculture and Food.
- The Ministry is primarily responsible for attaining the policies and goals set forth in Section 1 through appropriate programs, projects, and services.
Transfer of Bureau of Fisheries and Aquatic Resources (Section 3):
- The Bureau of Fisheries and Aquatic Resources is transferred from the Ministry of Natural Resources to the Ministry of Agriculture and Food.
- The Bureau is converted into a staff Bureau under the supervision and control of the Ministry.
- The Minister is authorized to integrate the Bureau's regional offices and field units into the Ministry's regional offices.
- The positions of Regional Director and Assistant Regional Director of the Bureau are abolished, but incumbents have priority for appointment as Assistant Regional Director for Fisheries and Aquatic Resources in the Ministry's regional offices.
- Incumbents not appointed may be accommodated in specialized senior technical positions at the same salary rate.
Abolition and Transfer of Functions (Sections 4-5):
- The Fishery Industry Development Council in the Ministry of Natural Resources is abolished, and its functions, appropriations, records, equipment, property, and personnel are transferred to appropriate units in the Ministry of Agriculture and Food.
- The National Board on the SEAFDEC Aquaculture Department Programs, Budget, and Operations is transferred to the administrative supervision of the Ministry of Agriculture and Food, with the Minister as the Chairman.
- All other functions and activities in the Ministry of Natural Resources directly related to fisheries and aquatic resources development and regulation are transferred to the Ministry of Agriculture and Food, including appropriations, records, equipment, property, facilities, and personnel.
Issuance of Forest Land Grazing Lease Agreements (Section 6):
- The issuance of forest land grazing lease agreements by the Bureau of Forest Development and the Ministry of Natural Resources shall be subject to the prior concurrence of the Ministry of Agriculture and Food through its regional offices, following guidelines promulgated by the Ministry upon the recommendation of the Director of Animal Industry.
Transfer and Attachment of Philippine Fisheries Development Authority (Section 7):
- The Philippine Fisheries Development Authority is transferred from the Ministry of Natural Resources and attached to the Ministry of Agriculture and Food, including its subsidiaries.
- The Minister of Agriculture and Food shall be the ex-officio Chairman of the Authority's governing board, while the Minister of Natural Resources shall remain a member.
Reconstitution of Governing Boards (Section 8):
- The Minister of Agriculture and Food shall be an ex-officio member of the governing boards of the Philippine Coconut Authority and the Philippine Sugar Commission.
- In the Philippine Coconut Authority's governing board, one of the two government representatives shall be the Minister of Agriculture and Food, and the President shall designate the Chairman and Vice-Chairman.
- In the Philippine Sugar Commission, one of the six Associate Commissioners shall be the Minister of Agriculture and Food.
Implementation and Personnel Actions (Sections 9-12):
- The Minister is authorized to issue orders, rules, and regulations necessary to implement the Executive Order, subject to the approval of the Office of Budget and Management for staffing patterns, organizational structure, and realignment of appropriations.
- The Minister may appoint personnel from the Bureau of Fisheries and Aquatic Resources and the abolished Fishery Industry Development Council to appropriate positions in the Ministry, and those not appointed are deemed laid off.
- The Minister shall effect the implementation, particularly personnel actions, within six months from the issuance of the Executive Order.
- All Presidential appointees of the Bureau of Fisheries and Aquatic Resources and the former Fishery Industry Development Council are laid off unless reappointed by the President.
- Career Executive Service Officers shall be reappointed or reassigned by the President upon the recommendation of the Minister, or assigned to the Career Executive Service Board for placement in other ministries or agencies.
- Those assigned to the Career Executive Service Board shall continue receiving their salaries from available and applicable funds, and those not placed within six months shall be laid off.
- All those laid off under the Executive Order shall be entitled to benefits and gratuities provided under existing laws.
- Present incumbents of positions in the Bureau of Fisheries and Aquatic Resources and the Fishery Industry Development Council shall continue exercising their usual functions, duties, and responsibilities, pending the issuance of implementing orders.
Repealing and Separability Clauses (Sections 13-14):
- All laws, decrees, orders, proclamations, rules, regulations, or parts thereof inconsistent with the provisions of this Executive Order are repealed or modified accordingly.
- If any portion or provision of this Executive Order is declared unconstitutional, it shall not nullify the other provisions, provided that the remaining portions can still stand and be given effect to accomplish the objectives of the Executive Order.
Effectivity (Section 15):
- This Executive Order shall take effect immediately.
