Executive Order No. 132

EXECUTIVE ORDER NO. 132 February 27, 1987

REORGANIZING THE DEPARTMENT OF FOREIGN AFFAIRS

WHEREAS, under Article II, Section 1, of the Provisional Constitution, as adopted in Proclamation No. 3 dated March 25, 1986, the President shall give priority to measures to achieve the mandate of the people to completely reorganize the government;

WHEREAS, Article XVIII, Section 16, of the 1987 Constitution recognizes that the reorganization of the government shall be continued even after the ratification of the Constitution;

WHEREAS, under Article XVIII, Section 6, of the 1987 Constitution, the President shall continue to exercise legislative powers until the First Congress is convened;

WHEREAS, the reorganization of the Department of Foreign Affairs must be undertaken in the context and furtherance of a unified government approach to foreign affairs, characterized by institutionalized, regular, and systematic coordination among all the departments involved, as well as by coherent planning and efficient implementation of the nation's foreign policy objectives:

Summary of Executive Order No. 132

Reorganization of the Department of Foreign Affairs
- Declares the policy to pursue an independent foreign policy for national recovery, growth, and development within the framework of national sovereignty, security, territorial integrity, national interest, self-determination, and commitment to international peace. (Sec. 3)
- Mandates the Department to advise and assist the President in planning, organizing, directing, coordinating, integrating, and evaluating the total national effort in the field of foreign relations. (Sec. 4)
- Outlines the powers and functions of the Department, including conducting foreign relations, maintaining representation with foreign governments, negotiating treaties, promoting trade and investments, protecting Filipinos abroad, and formulating foreign policy plans and programs. (Sec. 5)
- Vests the authority and responsibility of the Department in the Secretary of Foreign Affairs, who shall have supervision and control over the Department and the Foreign Service. (Sec. 6)
- Specifies the functions of the Secretary, including acting as the primary adviser to the President on foreign relations, establishing policies and standards, promulgating rules and regulations, and supervising attached agencies and corporations. (Sec. 7)
- Establishes the organizational structure of the Department, including the Office of the Secretary, Undersecretaries, Assistant Secretaries, support staff, home offices, and operations and foreign service units. (Sec. 8)
- Provides for the appointment and functions of Undersecretaries and Assistant Secretaries. (Sec. 9-11)
- Creates the Office of Legal Adviser, Office of Coordination, Inspection and Policy Planning, Office of Data Banking and Communication, Office of Protocol, State and Official Visits, Office of Intelligence and Security, and Office of International Economic Relations. (Sec. 12-17)
- Retains the Foreign Service Institute, UNESCO National Commission of the Philippines, and Technical Assistance Council. (Sec. 18-20)
- Establishes the Board of Foreign Service Administration and transfers the Law of the Sea Secretariat to the Department. (Sec. 21-22)
- Creates the Cultural Affairs and Public Information Services and Administrative Service. (Sec. 23-24)
- Outlines the functions and territorial or sectoral jurisdictions of the Home Offices. (Sec. 25)
- Creates the Secretariat on Foreign Policy Implementation to assist, coordinate, and monitor the organization of inter-agency missions negotiating foreign policies and agreements. (Sec. 26)
- Retains the Office of Consular Affairs and the Foreign Service establishments. (Sec. 27-28)
- Requires the Secretary to conduct a study and submit recommendations on the reclassification, reshuffling, consolidation, and creation of diplomatic and consular posts within 120 days. (Sec. 28)
- Attaches the Office of International Affairs and the Board of Foreign Service Examiners to the Department. (Sec. 29)
- Provides transitory provisions for the transfer of functions, personnel, assets, and liabilities during the reorganization. (Sec. 30)
- Requires the Secretary to approve and prescribe the new position structure and staffing pattern within 120 days, and provides for the separation and benefits of personnel not included or reappointed. (Sec. 31)
