Executive Order No. 115

EXECUTIVE ORDER NO. 115 December 24, 1986

REORGANIZING THE NATIONAL SECURITY COUNCIL AND DEFINING ITS MEMBERSHIP, FUNCTION, AND AUTHORITY AND OTHER PURPOSES.

WHEREAS, the formulation and adoption of integrated and rationalized national, foreign, military, political, economic, social and educational policies, programs, and procedures are vital to the security of the state;

WHEREAS, it is therefore, in the national interest that an agency exist purposely to formulate and adopt policies, programs, and procedures on all matters pertaining to or affecting the national security so that judgments and actions thereon by the President may rest on sound advice and accurate information.

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, do hereby order and direct:

Reorganizing the National Security Council and Defining Its Membership, Function, and Authority

Membership and Composition:
- The National Security Council (NSC) is composed of the following members (Section 1):
  • President
  • Vice-President and Minister of Foreign Affairs
  • Executive Secretary
  • Minister of National Defense
  • Minister of Justice
  • Minister of Labor and Employment
  • Minister of Local Government
  • National Security Director
  • Chief of Staff of the New Armed Forces of the Philippines
  • Other government officials and private citizens designated by the President

Executive Committee:
- The NSC has an Executive Committee composed of (Section 2):
  • President
  • Vice-President and Minister of Foreign Affairs
  • Executive Secretary
  • Minister of National Defense
  • National Security Director
  • Chief of Staff of the New Armed Forces of the Philippines
  • Other members or advisers designated by the President

Functions and Responsibilities:
- The NSC is the lead agency for coordinating the formulation of policies relating to or with implications on national security (Section 3).
- The President presides over the meetings of the NSC and Executive Committee, or may designate a member to preside in his/her absence (Section 4).
- The NSC has a permanent Secretariat under the supervision and control of the National Security Director (Section 5).
- The National Security Director attends and participates in Cabinet meetings with privileges of a member (Section 5).
- The National Security Director organizes the Secretariat, prepares its plans, budget, staff, and personnel, and promulgates rules and regulations for the operation of the Council and Secretariat, subject to the President's approval (Section 6).
- The National Security Director advises the President on national security matters and implements decisions and policies adopted by the President and/or NSC related to national security (Section 7).
- The NSC's duties include (Section 8):
  • Advising the President on integrating domestic, foreign, military, political, economic, social, and educational policies relating to national security (Section 8.1).
  • Evaluating and analyzing information, events, and incidents in terms of risks or implications to national security, and recommending appropriate responses (Section 8.2).
  • Formulating and coordinating the implementation of policies on matters of common interest to various government agencies concerned with national security, and making recommendations to the President (Section 8.3).
  • Ensuring that policies adopted by the NSC on national security are effectively and efficiently implemented (Section 8.4).
  • Making recommendations and rendering reports as directed by the President (Section 8.5).
- The National Intelligence Coordinating Agency (NICA) provides support and assistance to the NSC (Section 9).
- This Executive Order repeals inconsistent provisions of Presidential Decree 1498 on the National Security Council of the New Society and other laws, decrees, executive orders, letters of instructions, and edicts (Section 10).
- This Executive Order takes effect immediately (Section 11).
