PRESIDENTIAL DECREE No. 17 October 5, 1972

REVISING THE PHILIPPINE HIGHWAY ACT OF NINETEEN HUNDRED FIFTY THREE.

WHEREAS, acceleration of national economic development demands that complementary maintenance of existing infrastructure facilities, such as highways, be kept at the optimum;

WHEREAS, present situation calls for a more equitous reallocation of available resource to closely coordinated and technically determined and programmed needs of the entire nation and not merely of any portion thereof;

WHEREAS, as earlier pronounced, maximization of achievements go well along with minimum but efficient set-ups thus cutting down on unnecessary overheads; and

WHEREAS, the utilization of Highway Special Fund provided for by law should be carried out in accordance with the policies set forth.

Revising the Philippine Highway Act of Nineteen Hundred Fifty Three

Preamble:
- Acceleration of national economic development demands complementary maintenance of existing infrastructure facilities like highways.
- Need for more equitable reallocation of available resources based on technically determined and programmed needs of the entire nation.
- Maximization of achievements with minimum but efficient set-ups to cut down unnecessary overheads.
- Utilization of Highway Special Fund should be carried out in accordance with set policies.

Provisions:
- Adoption and decree of the Revised Philippine Highway Act as part of the law of the land.

Definitions (Section 2):
- "Highway" means any road, street, boulevard, avenue, alley, driveway, or other thoroughfare open to public travel.
- "National Road" means any highway maintained by the Bureau of Public Highways.
- "Provincial Road" means any highway maintained by the provincial government.
- "Municipal Road" means any highway maintained by the municipal government.
- "Barangay Road" means any highway maintained by the barangay government.
- "Private Road" means any highway maintained by a private person or entity.

Coverage and Exclusions (Section 3):
- This Act shall apply to all national roads, provincial roads, municipal roads, and barangay roads.
- This Act shall not apply to private roads.

Administration and Supervision (Section 4):
- The Bureau of Public Highways shall have direct supervision and control over all national roads.
- Provincial governments shall have direct supervision and control over all provincial roads within their respective jurisdictions.
- Municipal governments shall have direct supervision and control over all municipal roads within their respective jurisdictions.
- Barangay governments shall have direct supervision and control over all barangay roads within their respective jurisdictions.

Highway Special Fund (Section 5):
- A Highway Special Fund is hereby created, to be administered by the Bureau of Public Highways.
- The Fund shall be used exclusively for the construction, repair, and maintenance of national roads.
- The Fund shall be sourced from:
- Motor vehicle user's charges (Section 6)
- Toll fees and other charges (Section 7)
- Other sources as may be determined by law (Section 8)

Motor Vehicle User's Charges (Section 6):
- Motor vehicle owners shall pay an annual user's charge based on the weight and use of their vehicles.
- The specific rates shall be determined by the Bureau of Public Highways, subject to the approval of the President.

Toll Fees and Other Charges (Section 7):
- The Bureau of Public Highways may impose and collect toll fees and other charges for the use of national roads, bridges, and other highway facilities.
- The specific rates shall be determined by the Bureau of Public Highways, subject to the approval of the President.

Other Sources of Funds (Section 8):
- The Highway Special Fund may be augmented by funds from other sources as may be determined by law.

Penalties (Section 9):
- Any person who violates any provision of this Act or any rule or regulation issued pursuant thereto shall be punished by a fine of not more than five thousand pesos (₱5,000) or by imprisonment of not more than six (6) months, or both, at the discretion of the court.

Implementing Rules and Regulations (Section 10):
- The Bureau of Public Highways shall promulgate the necessary rules and regulations to implement the provisions of this Act.

Repealing Clause (Section 11):
- All laws, decrees, orders, rules and regulations, or parts thereof, inconsistent with the provisions of this Act are hereby repealed or modified accordingly.

Separability Clause (Section 12):
- If any provision of this Act is declared invalid or unconstitutional, the other provisions not affected thereby shall remain in full force and effect.

Effectivity (Section 13):
- This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
