Revising the Regulations Governing Aerial Navigation in Philippine Territory- Restrictions on Aircraft Flights:
• Only aircraft of the United States and Philippine governments are allowed to fly over Philippine territory. (Section 1)
• No aircraft other than those of the U.S. and Philippine governments shall fly within 15 miles from the perimeter of Corregidor Island, Manila Bay, and Subic Bay, Island of Luzon, or within 3 miles from the perimeter of Cavite Peninsula, Manila Bay, except with special authorization. (Section 2)
- Permissions and Licenses:
• Aircraft other than those mentioned in Sections 1 and 4 may fly in Philippine territory after obtaining permission as per Section 7 of Aeronautics Bulletin Number Three of the Bureau of Aeronautics, and may be escorted by Philippine Army airplanes when practicable. (Section 3)
• Local aircraft owned by private corporations or individuals must secure a license from the Director of Aeronautics in accordance with Commonwealth Act No. 168 and its regulations. (Section 4)
- Aerial Photography Restrictions:
• Aerial photography of any part of Philippine territory is prohibited, except those officially made by the U.S. and Philippine governments or agencies expressly authorized by the President of the Philippines. (Section 5)
• No aircraft other than those of the U.S. and Philippine governments shall carry any apparatus, instrument, or device for aerial photography without special written permission from the President of the Philippines. (Section 6)
- Violations and Enforcement:
• Any violation of this proclamation shall be dealt with in accordance with the law. (Section 7)
- Revocation of Previous Proclamations and Orders:
• Proclamation No. 324 dated September 24, 1938, and all other conflicting proclamations and executive orders are hereby revoked. (Section 8)
- Effective Date:
• The regulations shall become effective from the date of this proclamation, December 27, 1938. (Section 9)

BY THE PRESIDENT OF THE PHILIPPINES
Proclamation No. 364
REVISING THE REGULATIONS GOVERNING AERIAL NAVIGATION IN PHILIPPINE TERRITORY
Whereas it has been found necessary and expedient to exercise effective supervision and control over aerial navigation in the Philippines;
Now, therefore, I, Manuel L. Quezon, President of the Philippines, by virtue of the powers vested in me by law, do hereby issue the following regulations governing aerial navigation in Philippine Territory:
1. Except as hereinafter provided, no aircraft other than those of the United States and Philippine Governments shall fly over any Philippine territory.
2. No flying by any aircraft other than those of the United States and Philippine Governments shall be allowed within the distance of:
(a) Fifteen miles from the perimeter of the following named areas:
(1) Corregidor Island, Manila Bay.
(2) Subic Bay, Island of Luzon.
(b) Three miles from the perimeter of the following area:
(1) Cavite Peninsula, Manila Bay,
except that special exception may be authorized by proper authority.
