Case Overview and Summary

Revocation of Executive Order No. 427 (s. 2005) and Return of Infrastructure Facilities to DPWH

- Executive Order No. 427 (s. 2005) mandated the turnover of repair, maintenance, and management of three government-owned and DPWH-administered facilities to the City of Mandaue, subject to the execution of a deed of conveyance. (Section 1)
- The three facilities are: United Nations Avenue (Sta. 8+291 - Sta. 10+639, net length of 2.348 km.), AC Cortes Avenue (Sta. 7+196 - Sta. 9+507, net length of 2.311 km.), and Marcelo Fernan Bridge Access Roads to and from the Mini park (Mandaue Side) (Sta. 10+119 - Sta. 10+955 including the Mini park). (Section 1)
- No deed of conveyance has been executed between DPWH and the City of Mandaue, resulting in ambiguity over administration and lack of sufficient repair and maintenance of these facilities. (Section 1)
- The City of Mandaue, through its Sangguniang Panlungsod Resolution Nos. 13-555-2015 and 13-754-2015, requested for the return of the facilities to DPWH. (Section 1)
- Executive Order No. 427 (s. 2005) is revoked, and the repair, maintenance, and management of the facilities are returned to DPWH. (Section 1)
- All orders, proclamations, rules, regulations, or parts thereof, which are inconsistent with this Order are repealed or modified accordingly. (Section 2)
- This Order shall take effect immediately upon publication. (Section 3)
