RULES AND REGULATIONS AND AUTHORIZED ALLOWANCES COVERING OFFICIAL TRAVEL ABROAD OF GOVERNMENT PERSONNEL UNDER THE CATEGORY OF CONFERENCE, SPECIAL MISSIONS, AND OTHER NON-STUDY TRIPS
WHEREAS, present circumstances warrant a review of the existing rules and regulations governing official travel abroad of government personnel;
WHEREAS, to provide government personnel on official travel abroad with adequate financial means within the financial capability of the government to enable them to travel in a manner befitting their representative capacity and to uphold the prestige of the Republic of the Philippines and otherwise to represent the country with distinction and dignity, it is necessary to adjust/modify existing rules and regulations and authorized allowances covering official travel abroad;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Executive Order No. 401
Summary of Executive Order No. 401
Coverage and Approval (Sections 1-2):
- Governs official travels abroad of government personnel (national and local, including government-owned or controlled corporations) for conferences, special missions, and other non-study trips.
- Travels of Department Secretaries, Undersecretaries, Assistant Secretaries, and equivalent ranks require prior approval of the President.
- Other positions require prior approval of their respective Department Secretary or equivalent.
Nature of Travel (Section 3):
- Covers urgent and extremely necessary travels involving minimum expenditure and expected to bring immediate benefit.
- Includes attending conferences or seminars sponsored by foreign governments, international organizations, or private organizations (through respective governments).
- Conducting examinations, investigations, or undertaking official missions that cannot be assigned to officials already abroad.
Transportation (Section 4):
- If not provided by the host country or sponsoring organization, economy class transportation shall be allowed unless otherwise specified.
Clothing Allowance (Section 5):
- Granted based on position rank, ranging from $400 (highest rank) to $300 (lowest rank).
- Not granted more than once every 24 months, unless the difference is claimed if the previous allowance was lower.
Daily Allowance and Hotel Room Rate (Section 6):
- Daily allowance ranges from $100 (highest rank) to $50 (lowest rank), intended for subsistence, incidental expenses, and local transportation.
- Reimbursable hotel room rate limit ranges from $100 (highest rank) to $50 (lowest rank).
- Daily allowance granted only for the duration of the trip, including travel time (up to 3 days before and after the event).
- Actual hotel room rate reimbursement may be allowed for Department Secretaries and equivalent ranks upon prior approval of the President.
Representation Expenses (Section 7):
- Philippine delegations may be allowed reimbursable representation expenses necessary to uphold the country's prestige, represent with dignity, and carry out functions effectively, upon prior approval of the President.
- Includes expenses for entertainment, contributions, flowers, wreaths, etc., when justified by circumstances and customs.
Personnel Posted Abroad (Section 8):
- Officials and employees already posted abroad may avail of the allowances when instructed to travel outside their country-post or to countries under their non-resident accreditation or concurrent jurisdiction, provided funds are chargeable to the post allotment and no supplemental budget is requested, and with prior authority from their Department Secretary or equivalent.
Report Submission (Section 9):
- Officials or employees must submit a report with recommendations within 30 days after return, to the head of their office, department head, and the Office of the President.
- For international conferences or conventions, a delegation report must be submitted to the President through the Secretary of Foreign Affairs within one month after closing.
- Violation of this section subjects the official or employee to disciplinary action.
Insurance (Section 10):
- Reimbursement of accident insurance premiums up to PHP 200,000 for the duration of the official trip is allowed.
- Insurance for personal or household effects shall not be charged to government funds.
Payment of Allowance Differential (Section 11):
- If the host government or institution provides a lower per diem or allowance, the official or employee shall be entitled to the difference only.
Chargeability of Expenses (Section 12):
- Expenses for allowances and other authorized items shall be chargeable against the appropriations of the official's or employee's office, subject to availability of funds.
Rendition of Account of Cash Advances (Section 13):
- Officials or employees must render an account of cash advances received within 60 days after return, in accordance with applicable rules and regulations.
- Failure to comply will result in suspension of salary payment until compliance.
Implementing Authority (Section 14):
- The Secretary of Budget and Management shall issue rules and regulations to ensure effective implementation.
Repealing Clause (Section 15):
- Revokes or repeals provisions of Executive Orders No. 129 (1968), No. 421 (1973), No. 367 (1989), and the Cabinet Resolution of June 11, 1986, that are inconsistent with this Order.
