THE DANGEROUS DRUGS ACT OF 1972

Section 1. Short Title. This Act shall be known and cited as "The Dangerous Drugs Act of 1972."

ARTICLE I
Definition of terms

Section 2. Definitions. As used in this Act, the term:

(a) "Administer" refers to the act of introducing any dangerous drug into the body of any person, with or without his knowledge, by injection, ingestion or other means or of committing any act of indispensable assistance to a person in administering a dangerous drug to himself;

(b) "Board" refers to the Dangerous Drugs Board created under Section 35, Article VIII of this Act;

(c) "Centers" refers to any of the treatment and rehabilitation centers for drug dependents referred to in Section 34, Article VII of this Act;

(d) "Cultivate or culture" means the act of knowingly planting, growing, raising or permitting the planting, growing or raising of any plant which is the source of a prohibited drug;

(e) "Dangerous drugs" refers to either:

- Employees and visitors of drug den: 2 years and 1 day to 6 years imprisonment, 2,000 to 6,000 peso fine (Section 6)
- Manufacture of prohibited drugs: life imprisonment to death, 20,000 to 30,000 peso fine (Section 7)
- Possession or use of prohibited drugs: 6 years and 1 day to 12 years imprisonment, 6,000 to 12,000 peso fine; for Indian hemp, 6 months and 1 day to 6 years imprisonment, 600 to 6,000 peso fine (Section 8)
- Cultivation of plants that are sources of prohibited drugs: 14 years and 1 day to life imprisonment, 14,000 to 30,000 peso fine; land to be confiscated (Section 9)
- Failure to maintain records on prohibited drugs: 1 year and 1 day to 6 years imprisonment, 1,000 to 6,000 peso fine; license revocation for practitioners (Section 10)
- Unlawful prescription of prohibited drugs: 8 years and 1 day to 12 years imprisonment, 8,000 to 12,000 peso fine (Section 11)
- Unnecessary prescription of prohibited drugs: 4 years and 1 day to 12 years imprisonment, 4,000 to 12,000 peso fine; license revocation for practitioners (Section 12)
- Possession of drug paraphernalia: 6 months and 1 day to 4 years imprisonment, 600 to 4,000 peso fine (Section 13)

Regulated Drugs (Article III)
- Importation of regulated drugs: 6 years and 1 day to 12 years imprisonment, 6,000 to 12,000 peso fine (Section 14)
- Sale, administration, dispensation, delivery, transportation, distribution of regulated drugs: 6 years and 1 day to 12 years imprisonment, 6,000 to 12,000 peso fine; license revocation for practitioners (Section 15)
- Possession or use of regulated drugs without license/prescription: 6 months and 1 day to 4 years imprisonment, 600 to 4,000 peso fine (Section 16)
- Failure to maintain records on regulated drugs: 6 months and 1 day to 4 years imprisonment, 600 to 4,000 peso fine (Section 17)
- Unlawful prescription of regulated drugs: 4 years and 1 day to 8 years imprisonment, 4,000 to 8,000 peso fine (Section 18)
- Unnecessary prescription of regulated drugs: 6 months and 1 day to 4 years imprisonment, 600 to 4,000 peso fine; license revocation for practitioners (Section 19)

Common Provisions (Article IV)
- Confiscation and forfeiture of proceeds/instruments of the crime (Section 20)
