Executive Order No. 317

EXECUTIVE ORDER NO. 317 February 5, 1988

AMENDING SECTIONS 1, 3 AND 4 OF EXECUTIVE ORDER NO. 309, S. 1987 ENTITLED "REORGANIZING THE PEACE AND ORDER COUNCIL"

WHEREAS, there is a need to clarify certain provisions of Executive Order No. 309 and to expand the membership of the Peace and Order Council, in order to ensure more comprehensive and effective coordination of government efforts and the active participation of citizenry relative to the conduct of national campaign against criminality and insurgency;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, do hereby order:

Sec. 1. Section 1 of Executive Order No. 309 is hereby amended to read as follows:

"Sec. 1. Reorganization of the Peace and Order Council. The Peace and Order Council is hereby reorganized on the national, regional, provincial, city and municipal levels of government to be constituted as follows:

(a) The National Peace and Order Council

The Secretary of Local Government as Chairman;

The Secretary of National Defense as Vice-Chairman;

The Secretary of Justice;

Summary of Executive Order No. 317

Reorganization of the Peace and Order Council (Sec. 1)
• Reorganizes the Peace and Order Council at the national, regional, provincial, city, and municipal levels.
• Outlines the composition and membership of the councils at each level, including government officials and private sector representatives.

National Peace and Order Council (Sec. 1a)
• Chaired by the Secretary of Local Government.
• Vice-Chaired by the Secretary of National Defense.
• Members include various government secretaries, agency heads, and eight private sector representatives appointed by the Chairman.

Regional Peace and Order Council (Sec. 1b)
• Composed of regional counterparts of the departments, offices, and agencies represented in the National Peace and Order Council.
• Chairman and Vice-Chairman appointed by the Chairman of the National Peace and Order Council.
• At least three private sector representatives appointed by the RPOC Chairman.

Provincial Peace and Order Council (Sec. 1c)
• Composed of provincial counterparts of the departments, offices, and agencies represented in the National Peace and Order Council.
• Provincial Governor as Vice-Chairman.
• One representative from the Sangguniang Panlalawigan.
• At least three private sector representatives appointed by the PPOC Chairman.

City or Municipal Peace and Order Council (Sec. 1d)
• Composed of city or municipal counterparts of the departments, offices, and agencies represented in the National Peace and Order Council.
• City or Municipal Mayor as Chairman, and respective Vice-Mayor as Vice-Chairman.
• One representative from the Sangguniang Panglungsod or Sangguniang Bayan.
• One representative from the Veterans group of the locality.
• At least three private sector representatives appointed by the CPOC or MPOC Chairman.

Duties and Functions of Sub-National Councils (Sec. 3)
• Formulate plans and recommend measures to improve peace, order, and public safety in their respective areas. (Sec. 3a)
• Monitor the implementation of peace and order programs, projects, and counter-insurgency activities. (Sec. 3b)
• Conduct periodic assessments of the prevailing peace and order situation and submit reports with recommendations to the National Peace and Order Council. (Sec. 3c)
• Receive complaints against government personnel and demand action from the concerned agency. (Sec. 3d)

Peace and Order Council Secretariat (Sec. 4)
• Handles administrative and technical activities of the Peace and Order Council at various government levels.
• Prepares plans and programs, supervises implementation, coordinates activities, and provides a forum for deliberation.
• National and regional offices of NAPOLCOM serve as the secretariat for NPOC and RPOC, respectively.
• At the provincial, city, and municipal levels, the secretariat is headed by the most senior DLG officer stationed in the area.
• The secretariat is assisted by the regular staff of the office of the Council Chairman at all levels.
